Death of Lily Burk; California’s Dysfunctional Court Systems’ Three Strikes Law, Fails to protect another Teenager’s LIFE from a Dangerous Criminal:By Marc Chamot
“What’s good for one race should be equally as good for the other, right?” Attorney General Eric Holder and Obama brought up race during the campaigns and most recently.
Oh yeah, I forgot, this wasn’t another “black” Harvard professor being under the illusion of being racially discriminated by white cops.
It was a precious 17 year old white girl being kidnapped, robbed and murdered in her own car, by a black man, a habitual dangerous criminal, and one of those thousands who roam around the state of California with rap sheets a mile long.
Here is just another black on a white child crime, but where are President Barack Obama and Eric Holder on this one? Let’s talk about race; I’m not a “coward,” shall we?
How many more of our precious children, whether black, Latino and white, are going to be raped and murdered by California’s dysfunctional felon laws and its CRAZY court systems?
Liberal California judges and its court systems allow mainly “minorities,” and “white” sex predators, to be let loose and free in this society, and to even circumvent California’s “three strikes laws.”
This scumbag, and dirt bucket, Charles Samuel, should have been locked up for life; his criminal record qualified him for it. But no, he was let out, and then brutally murdered this promising scholarly girl the other day.
What in the HELL is California’s three strikes law FOR, if our idiotic court systems don’t want to follow its mandates?
This law was enacted by angry California voters in 1994, those who were getting sick and tired of these criminals running amuck and killing in their cities.
The first true "three strikes" law, voters approved Initiative 593. California passed its own in 1994, when that state voters passed Proposition 184 by an overwhelming majority, 72% in favor and 28% against. The initiative proposed to the voters had the title of Three Strikes and You're Out, referring to de facto life imprisonment after being convicted of three felonies.
The law was intended to put murderers, rapists and hardcore violent criminals in prison for 25 years to life, but 65 percent of those imprisoned have been sentenced for nonviolent offenses.
California’s Three Strikes law is the harshest in the country. No other state allows someone to be convicted under Three Strikes for a nonviolent offense.
Charles Samuel was a prime candidate for California’s three strikes law, and for life in prison, after a felony and series of serious misdemeanors. And on top of it, he racked up three none drug related felonies!
But to this guy, EVEN three felonies did not equal life in prison under the California three strikes law:
1987: Felony home invasion robbery, felony burglary, unlawful taking of vehicle in San Bernardino.
1997: Felony burglary in San Bernardino.
2006: Felony petty theft with prior theft in Los Angeles.
Samuel should have been locked up before his third felony in 2006, but he was not, and yet he was allowed to murder an innocent 17 years old child three years later.
This poor sweet girl, Lily Burk was only running errands for her mom, when this MONSTER grabbed her, kidnapped, robbed and murdered her.
Folks, I will keep on saying it again and again, California’s justice system on minorities and other felons is a system in total shambles.
Another by-product of a failed enforcement of the tree strikes law, do you all remember Lovelle Mixon, the killer of the four Oakland cops? This guy never belonged in the streets, but did anyway, and four GOOD cops got murdered.
This liberal court systems in the state of California, has become protectionists for these viperous and extremely dangerous criminals.
Rather than providing a safer society for its law abiding citizens, mainly security for children and for those who want to run about free from dangerous criminals. This state government and its court systems, keep putting everybody’s lives in deeper danger.
This Charles Samuel has better get the death penalty for his crime, just as I supported the death penalties for those three white racists, in the viscous dragging death murder of an innocent, and decent black man, James Byrd of Jasper Texas.
Suspect in Lily Burk's slaying had 10 prior convictions, DA says
1:02 PM July 29, 2009
The man charged in the slaying of 17-year-old Lily Burk has 10 criminal convictions in the last 30 years including felony burglary and home invasion, according to information from the L.A. Dist. Atty.'s Office.
Most of the convictions were for misdemeanor crimes such as DUI and theft, according to the information, which The Times requested.
Charles Samuel, 50, was charged Tuesday with murder, kidnapping and robbery -- charges that could make him subject to the death penalty.
Burk never returned to her family's Los Feliz home Friday after running an errand for her mother at Southwestern Law School in the city's Mid-Wilshire area. In the afternoon, she made two odd calls to her parents asking how to use a credit card to withdraw cash at an ATM. About 7 p.m., they contacted police to report her missing. Later that night, police tracked Burk's cellphone and ATM activity to the skid row and Little Tokyo areas, but a search into the early hours of Saturday morning turned up nothing.
At dawn, however, Burk's lifeless body was discovered in the passenger seat of her Volvo in a downtown parking lot. She had been beaten about the head and her neck was slashed. Here is the list of the suspect's convictions:
1978: Misdemeanor grand theft in San Bernardino County.
1981: Misdemeanor petty theft in San Bernardino.
1985: Misdemeanor providing false information to a peace office in San Bernardino.
1985: Misdemeanor under the influence of a controlled substance in San Bernardino.
1986: Misdemeanor under the influence of a controlled substance in San Bernardino.
1987: Felony home invasion robbery, felony burglary, unlawful taking of vehicle in San Bernardino.
1997: Felony burglary in San Bernardino.
2003: Misdemeanor driving on a suspended license in Los Angeles County.
2006: Felony petty theft with prior theft in Los Angeles.
2009: Misdemeanor possession of drug paraphernalia in Los Angeles.
Samuel has not entered a plea in Burk's slaying.
Police said they have collected footage from surveillance cameras showing Samuel driving away from the area of the law school in Burk's car with her in the passenger seat, with Burk at a downtown ATM machine and then abandoning the car late Friday afternoon in the parking lot where Burk's body was found.Fingerprints lifted from the inside of the car have been matched to Samuel, who reportedly made incriminating statements to detectives after his arrest. They believe that Burk was killed within about 45 minutes of her last call to her parents and hours before she was reported missing.

Wow! Can I please have back the time I spent reading this rant? This was full of factual errors and your simple minded analysis of how a catchy slogan (ie.."3-strikes and your out") can solve a complicated problem is anything but useful.
I recently came accross your blog and have been reading along. I thought I would leave my first comment. I dont know what to say except that I have enjoyed reading. Nice blog. I will keep visiting this blog very often.
